Abstract
Après avoir soulevé d'intenses débats et bien des controverses durant la première moitié du XX e siècle, la théorie de l'imprévision devait sombrer lentement dans les sphères de l'oubli. L'instabilité économique chronique paraissait vaincue, les discussions sur l'adaptation des contrats aux nouvelles circonstances semblaient ainsi anachroniques. Les diverses crises économiques qui se sont succédé depuis le début des années 1970 ont contribué à relancer les discussions doctrinales sur ce sujet. Certains pays ont franchi le Rubicon et ont consacré la révision judiciaire des contrats touchés par les aléas du temps et de la nature. On pense notamment aux droits allemand, hollandais, italien, grec et algérien. Au Québec, la théorie de l'imprévision n'a guère suscité de passions et n'a trouvé que peu de défendeurs. Les arguments de ses détracteurs s'avèrent invariables : force obligatoire des contrats, sécurité juridique des transactions, peur endémique de l'arbitraire judiciaire. Plus qu'un plaidoyer, notre étude se présente comme une contre-argumentation, une tentative de projeter certains mythes dans les réalités de cette fin de siècle. La théorie de l'imprévision n'est ni une hérésie juridique, ni un blasphème dirigé contre la tradition civilis te du droit des obligations.
