Abstract
La légitimité du pouvoir législatif a été construite sur la base du concept de représentation, alors que la démocratie représentative s’est imposée comme le modèle politico-juridique de la modernité. Pourtant, chez les penseurs modernes, le gouvernement représentatif n’était pas synonyme de démocratie. Ce n’est que par la suite que les deux modèles seront confondus. En effet, avec le triomphe de la Raison, la légitimité découle du consentement, le souverain devant dès lors être représenté. Cette conceptualisation du pouvoir législatif est remise en question par certaines transformations contemporaines qui fragilisent la légitimité de la démocratie représentative. D’une part, l’évolution des systèmes politique et électoral démontre les limites de la possibilité de représenter. D’autre part, le positivisme juridique dérivé de la démocratie représentative a orienté l’interprétation législative vers la recherche de l’intention du législateur. Cette thèse intentionnaliste se révèle néanmoins problématique lorsqu’elle est jugée du point de vue des théories contemporaines du langage.
