L’intimité n’est pas qu’une petite affaire privée, au présent immédiat ou gagnée par des interactions, son historicité puise dans le politique et le droit au xviie siècle qui accorderont une place inédite au « for intérieur ». Chevillée au secret, l’intimité se fabriquera sur deux genres de propriétés distinct et consacrés par le droit : la propriété privée et la propriété de soi. Possession d’un lieu et possession d’un corps à l’abri de la vue, l’homme privé se réalisera par cette double puissance, une protection à la recherche de confiances et où les sociabilités ne se confondront plus jamais avec la société. Ce texte explore les figures de l’intimité dans le droit et la jurisprudence du xixe siècle, une sorte de répliques du pouvoir domestique où l’attache personnelle, la parole attachée, les mouvements du corps sont interrogés.
