Abstract
O licenciamento ambiental é um dos instrumentos de comando e controle mais importante da Política Nacional de Meio Ambiente. Com a Lei Complementar nº 140/2011, os municípios foram provocados e submetidos a condições para organizarem suas gestões e assumirem a responsabilidade pelo licenciamento ambiental de impacto local. Nesse sentido, este artigo buscou avaliar a capacidade (estrutura) dos 9 municípios que compõem o Território do Piemonte Norte do Itapicuru (Bahia), para exercer licenciamento ambiental de impacto local. O presente estudo foi desenvolvido a partir do levantamento de informações que elucidem sobre a estrutura dos Sistemas Municipais de Meio Ambiente (Resolução CEPRAM nº 4.327/2013). Tendo em vista os resultados encontrados, verifica-se um número expressivo de municípios que realizam o licenciamento ambiental sem cumprir com os requisitos propostos pela Resolução CEPRAM nº 4.327/2013. De modo geral, fatores como a ausência ou baixo número de profissionais capacitados, fiscalização ambiental lei orgânica ambiental, conselho e fundo de meio ambiente apontam sobre a fragilidade da gestão ambiental de todos os municípios. Nesse contexto, seguindo a Resolução CEPRAM nº 4.327/2013, apesar de autodeclarem aptos, conclui-se que todos os municípios estão inaptos para exercer o licenciamento ambiental.
