Pernikahan tanpa Pencatatan: Kegagalan Negara dalam Melindungi Hak Sipil Perempuan dan Anak

Abstract
Artikel kebijakan ini membahas fenomena pernikahan tidak tercatat di Indonesia sebagai cerminan kegagalan negara dalam menjamin hak-hak sipil perempuan dan anak. Pernikahan tanpa pencatatan resmi, baik dalam bentuk nikah siri maupun adat, menimbulkan dampak serius terhadap perlindungan hukum, terutama bagi kelompok rentan. Perempuan kehilangan hak atas nafkah, perlindungan dalam perceraian, dan akses keadilan, sementara anak-anak berisiko tidak memiliki akta kelahiran, sehingga kesulitan mengakses pendidikan, layanan kesehatan, dan bantuan sosial. Fenomena ini diperparah oleh ketimpangan layanan pencatatan di wilayah 3T, rendahnya literasi hukum, serta kuatnya norma sosial keagamaan dan adat yang kerap menegasi hukum negara. Tulisan ini menggunakan metode kualitatif dengan pendekatan deskriptif-analitis berbasis studi pustaka, menganalisis regulasi, laporan lembaga terkait, dan publikasi akademik. Selain itu, digunakan teknik analisis isi serta kerangka USG (Urgency, Seriousness, Growth) untuk mengevaluasi tingkat kedaruratan dan pertumbuhan masalah. Dengan landasan teori Hegemoni Gramsci, Legal Pluralism, dan Ketidaksetaraan Struktural, artikel ini mengidentifikasi kesenjangan antara hukum formal dan praktik sosial yang menyebabkan perempuan dan anak berada dalam posisi rentan. Hasil analisis menunjukkan bahwa reformulasi regulasi pencatatan perkawinan merupakan alternatif kebijakan paling strategis dan efektif. Kesimpulannya, negara perlu hadir melalui reformasi regulatif, edukasi hukum, integrasi dengan norma lokal, serta perluasan layanan pencatatan untuk menjamin perlindungan hukum yang adil dan setara bagi seluruh warga negara.
