תקציר בעברית: בפרשת יששכרוב העניק בית המשפט פרשנות מחודשת לדרישת הרצוניות של הודאה שניתנה מחוץ לבית המשפט ואימץ – בהתבסס על המודל הקנדי (סעיף 24 ( 2) לצ'רטר הקנדי והלכת Collins המפרשת את דרישותיו) – דוקטרינה פסיקתית לפסילת ראיות שהושגו שלא כדין, המקנה לבית המשפט כלי דיוני משמעותי לשמירה על זכויות נאשמים. מבלי למעט בחשיבות שבעצם אימוצו של כלל פסלות הראיות, יטען המאמר כי בחינה מדוקדקת של הלכת יששכרוב מלמדת כי היא אינה נותנת הגנה ראויה לזכויות של חשודים ונאשמים, וזאת ביחס לשני הראשים של החלטת בית המשפט.ככל שהדבר נוגע לדרישת הרצוניות, טוען המאמר כי בית המשפט העליון נמנע מלייחס את החשיבות הראויה לזכות ההיוועצות בסנגור כאמצעי החיוני לחשוד לשם קבלת החלטה מושכלת אם למסור גרסה או לשמור על שתיקה, ושגה במסקנה כי הודאתו של יששכרוב הייתה רצונית בהיעדרה של הודעה על הזכות להיוועץ בסנגור ובהיעדר מודעות בפועל לזכות זו. בהקשר זה מציע המאמר לאמץ את תובנותיו של בית המשפט העליון האמריקני כפי שבאו לידי ביטוי בפרשת Miranda . בהתאם לפרשנות זו, טוען המאמר כי ראוי היה לפסול את הודאתו של יששכרוב מכוח כלל הפסילה הקבוע בסעיף 12 לפקודת הראיות, ולא מכוח דוקטרינת הפסילה הפסיקתית.באשר לדוקטרינה הפסיקתית של כלל פסלות הראיות טוען המאמר כי בחירתו של בית המשפט להסתמך על המודל הקנדי לפסילת ראיות אמנם ראויה ככלל, אולם האופנים שבהם בחר בית המשפט לסטות ממודל זה עשויים להביא לצמצום בלתי- ראוי בהיקף תחולתו של כלל הפסילה, צמצום שאינו נובע מהצורך להתאימו לצורכי המציאות המשפטית בישראל. חרף התוצאה המבורכת שבאימוצה של דוקטרינה לפסילת ראיות, מבקש המאמר להראות כי כלל הפסילה נוסח בצמצום מופרז, וכי באופן התווייתן של אמות-המידה להפעלתו יש בבירור כדי להטות את האיזון לעבר הערך שבגילוי האמת, באופן שאינו עולה בקנה אחד עם תכליתו המוצהרת של הכלל. אמנם, בפרשת יששכרוב נותר בידי בתי המשפט שיקול דעת רחב ביותר (ולמעשה, בלתי- מוגבל) בדבר אופן החלת הכלל, אך בה בעת, הקביעה כי מהימנות הראיה, אופן סיווגה, חיוניותה וחומרת העבירה משמשים שיקולים רלבנטיים כל אימת שבית המשפט נדרש לשקול פסילתה של ראיה שהושגה שלא כדין, מבלי לנקוט עמדה בדבר משקלם היחסי, עלולה להביא לצמצום בלתי-ראוי בהיקף תחולתו של כלל הפסילה. לפיכך מציע המאמר נוסחה רחבה יותר מזו שאימץ בית המשפט בעניין יששכרוב, והבניה נוקשה יותר להפעלת שיקול הדעת השיפוטי – כזו המקנה משקל משמעותי יותר להגנה על זכויות הנאשם, בדומה לאופן הבנייתו של שיקול הדעת במשפט הקנדי העדכני, המבטא איזון ראוי בין האינטרס שבגילוי האמת ובהרשעת עבריינים מחד גיסא לבין האינטרס שבהגנה על זכויות הנאשם מאידך גיסא.English Abstract: In the Issacharov case, the Supreme Court gave a novel interpretation to the voluntariness requirement for an extrajudicial confession and - based on the Canadian model (section 24(2) of the Canadian Charter of Rights and Freedoms, and the Collins ruling, which interprets its requirements) - has adopted a judicial doctrine for the exclusion of illegally obtained evidence, granting the court an important procedural tool for protecting the rights of accused persons. Without minimizing the significance in the very adoption of an exclusionary rule, this article will argue that a careful examination of the Issacharov ruling shows that it does not provide adequate protection for the rights of suspects and defendants as this relates to the two parts of the Court's decision.Insofar as it relates to the requirement of voluntariness, this article argues that the Supreme Court failed to ascribe proper significance to the right to counsel - as an essential tool enabling suspects to reach an informed decision whether to provide a statement or remain silent - and erred in concluding that Issacharov's confession was voluntary in spite of the fact that he was not notified of the right to counsel and was, indeed, unaware of this right. In this context, the article proposes to adopt the insights of the US Supreme Court as expressed in the Miranda ruling. According to this interpretation, the authors claim that Issacharov's confession should have been excluded pursuant to the exclusionary rule set forth in section 12 of the Evidence Ordinance, and not by means of a judicial doctrine for excluding evidence.Regarding the judicial exclusionary rule, this article states that the Court's decision to rely on the Canadian exclusionary model is indeed proper. However, the manner in which the Court has chosen to deviate from this model could lead to an inappropriate restriction in the exclusionary rule's scope of application - a restriction that does not stem from the need to adapt it to Israeli legal reality. Notwithstanding the positive result in the adoption of an exclusionary doctrine, the authors claim that the exclusionary rule's formulation is excessively restrictive and that its criteria might be applied in a way that may indeed tip the scales in favor of the value of ascertaining the truth, in a way that is incompatible with the declared purpose of the rule. Indeed, under the Issacharov ruling, extremely broad (virtually, unlimited) discretion remains in the hands of the courts regarding the manner for applying the rule; however, at the same time, the ruling whereby the credibility, classification, and essentiality of the evidence, as well as the severity of the offense, all serve as relevant factors whenever the court must consider the inadmissibility of illegally obtained evidence, without taking a position regarding the relative weight of these factors - could lead to an improper restriction in the exclusionary rule's scope of application. Therefore, this article proposes a broader formulation than that adopted by the Court in Issacharov, and a stricter construction for exercising judicial discretion - one that would provide greater weight to protecting the rights of the accused, similar to the way in which discretion is currently structured under Canadian law, which reflects a proper balance between the interest in ascertaining the truth and convicting offenders, on the one hand, and the interest in protecting the rights of the accused, on the other hand.
