The late Mr. Joe Vogler owned about 150 patented and unpatented mining claims in the Woodchopper and Webber Creek area, within the boundaries of the Yukon-Charley National Park and Preserve. On July 14, 1984, while Joe and fellow miners drove heavy equipment up the Bielenberg Trail to their mines, a helicopter landed on the trail. According to Joe's quote to the Daily News-Miner, several Park officials with "semi-automatic weapons and sidearms" appeared to serve him with a temporary restraining order and then transported him back to Circle. The Federal Government charged him with traveling through the park without a permit, for not filing a plan of operations for mining, and for being off the trail and damaging the tundra. After 4 years of litigation, in a case brought by the U.S., the Northern Alaska Environmental Center, the Sierra Club, and the Wilderness Society, the 9th Circuit Court of Appeals upheld a permanent injunction against Mr. Vogler. In the meantime the National Park Service directed Joe to transport his equipment into his property where it still sits idle today. (Gelvin) But his story did not begin in 1984, nor is it over yet. This paper will explain the conflict between Mr. Vogler and the National Park Service (NPS). However, the contention arises from separate interests between the State of Alaska and the Federal Government, and from the plethora of seemingly contradictory and inefficient law that further muddles the issue. This story will bring together the applicable law and it will become painfully clear that the written process for settling disputes or for asserting existing rights differs significantly from what actually occurs. The paper will conclude with the current project undertaken by the State to formally retain those rights and the Federal response to that effort.
