Résumé
The Canadian cable industry has been deeply engaged in the fight against digital piracy. Industry-led schemes and government measures serve as a toolkit to curb the growth of online piracy in the Canadian media ecosystem. This panel will review the Canadian experience and discuss the status of antipiracy schemes with the backdrop of a formal review of the Copyright Act that will take stock of Canada’s legal measures to address digital piracy. Canada’s Copyright Act mandates a full parliamentary review in the fall of 2017, five years after enactment of the Copyright Modernization Act. The review will consider Canadian antipiracy measures that have, by and large, received mixed reviews from the creative and IP communities. On one hand, the Canadian cable industry has had significant success in stemming piracy, particularly in the sale of illegal set-top boxes and shutting down operations of sports-related video streaming host sites and cyberlockers. On the other hand, regulatory measures set up by the Copyright Act, such as the notice-on-notice policy, have received mixed reviews. The US-based International Intellectual Property Alliance (IIPA) has notably suggested that Canada’s enforcement by police, prosecutors, and courts, are “major pieces of unfinished business” that the Copyright review should consider. Examining the status of antipiracy measures in Canada will enrich and deepen the TPRC community’s knowledge of piracy and its impact on the cable and telecommunications industry. The panel will frame the challenge and ignite a data-driven, candid conversation using Canada as a case-study. The TPRC community will grapple with the big and broad question on how to ensure that the internet remains a meaningful and transformative technology for the digital economy, while respecting rights-holders in the media industry. In particular, the panel will weave together three themes. First, it will review the body of research that provide an assessment of the value of copyrighted content through piracy ecosystems, including by downloading, by streaming, or by jumping geo-fences. Subsequently, the panel will review Canadian and international anti-piracy measures -- legal, regulatory and advocacy-related. Lastly, the panel will determine the economic evidence of anti-piracy strategies implemented by industry and government in Canada and other jurisdictions. By evaluating various schemes and tools, the panel will be able to determine the effectiveness of antipiracy policies.
