Fiery Foundations of Federalism: The Enduring Legacy of Citizens Insurance Co v Parsons

As part of the Law Society of Upper Canada’s Special Lectures on the 150th anniversary of Confederation, the author was asked to select a case involving the federal division of legislative powers that has had a significant lasting impact on Canadian constitutional law. The author chose the 1881 ruling of the Judicial Committee of Privy Council in Citizens Insurance Co v Parsons. The article describes the origins of the litigation in a fire that destroyed William Parsons’ hardware store, one of many fires that broke out on Broadway, the main street in Orangeville, Ontario, in the 1870s. When Parsons was denied recovery for his losses by a number of insurance companies, he sought recovery in the courts. A central issue in his case was the validity of Ontario’s Fire Insurance Act, passed in 1876. Was it within provincial jurisdiction over “property and civil rights”, or was it an invasion of federal jurisdiction over “trade and commerce”? Situating the ultimate ruling of the Privy Council in its historical context, a time of intense contestation between “imperial federalists” and “equal federalists” over the meaning of the constitution, the author highlights three legacies of the Privy Council’s ruling. First, the Privy Council’s outline of the division of jurisdiction between Parliament and the provincial legislatures regarding economic regulation has survived intact to this day. One hundred and thirty six years after the opinion was released, we still begin our analyses of the scope of federal power in relation to “trade and commerce”, and provincial power in relation to “property and civil rights”, with Parsons. No other rule of Canadian constitutional law has stood the test of time so long and so well. Secondly, the opinion adopted a vision of equal federalism that recognized the provincial legislatures and the federal Parliament as equally sovereign and possessing equal powers within their respective spheres. Finally, the Parsons opinion was the first to recognize Quebec’s distinctiveness as a fundamental principle that should guide the interpretation of the Canadian constitution. This was the Privy Council’s most creative and far-sighted contribution to Canadian jurisprudence, one that is reflected in many modern constitutional decisions interpreting both the Constitution Act, 1867 and the Constitution Act, 1982. While these features of Canadian federalism are now deeply embedded in our constitutional jurisprudence, we should celebrate Parsons as a landmark – in its first ruling that explored the federal features of the British North America Act in depth, the Privy Council made decisive choices that have shaped the country.
