Legal Basis for the set-up of Higher Education in Denmark Right to educationThe right to education is enshrined in the Constitutional Act of Denmark, section 76, establishing that all children are entitled to free education, and at the same time have a duty to receive education.The Primary Education Act 1 establishes that in Denmark there are nine years of compulsory education, free of charge. 2 The Act on Universities 3 regulates Higher Education in Denmark.Universities comprise a bachelor education of three years, after which a student can decide to continue towards a master's education of two years.Thus educational programmes at Higher Education Institutions (hereinafter HEI) have a total duration of five years.Academic theories and methods constitute the basis of the degrees, which at the same time provide wide subject knowledge and deeply specialized knowledge.A student who has obtained a master's degree can apply for a researcher position in order to obtain a Ph.D. title.The Act on University establishes the rules for the organization of universities, which are independent institutions financed by the state, and as such under the oversight of the Ministry of Higher Education.There are currently five universities in Denmark, based in Copenhagen, Aarhus, Aalborg, Odense (University of Southern Denmark), and Roskilde.The last major change in the Act on Universities took place in 2003, when the universities became independent institutions with an appointed -by the Ministry -board of directors as top management.The reform considerably increased the power of the management (rector, deans, and vice deans) at the expenses of collegial organs such as the academic council, the study board and other relevant board, which are still elected by the employees.The Danish Accreditation Institution, established in 2007, has a mission to ensure and develop "quality and relevance in higher education degrees and institutions". 4 In order to sustain a transparent and coherent Higher Education system, the accreditation process is no longer programme-based; instead, the basis of accreditation focuses on the institutions, and not on the individual programs of the various HEIs.Other education that follow secondary education in Denmark, and which combine theoretical with practical education, often including a period of stage or internship at firm or public employer, are profession bachelor educations (professionbacheloruddannelser, of a three and 1 Bekendtgrelse af lov om folkeskolen, LBK nr.823 af 15/08/2019. 2 However, children may receive education at home or at a private school, on the condition that the course of education is equivalent to the general primary school standard.The State subsidizes private schools, but in general, parents who decide not to send their children to the primary school (out of educational or religious reasons) must pay for their children's education. 3 Lovbekendtgrelse om universiteter, nr.778 af 07/08/
