Légalisation des drogues illicites et santé publique

The question of illegal classified drugs and prohibition which defines them as some is a part of these stakes in society which tip over easily in the field of the politically moral and of socially emotional person. To write on the subject turns out thus delicate. Nevertheless, it seemed to us important to try to explain the reasons for which the debate ori the usage of drugs and drug addiction, initiated since so for a long time did not invite the Canadian society to want to make a commitment in a deep change of its policy on drugs. Nevertheless, every observer, on the only report of the bankruptcy of the prohibition, can wonder if it would not simply be to show common sense that to establish a frame more adapted to the current phenomena of drugs and to the general evolution of the customs, rather than to laud an even wilder repression and an even more merciless prohibition. The sociohistorical analysis of the prohibition on drugs at the international level, as at the Canadian national level, allows us to demonstrate that the device elaborated to control the demand of drugs, classified illicit, did not arise from a political reaction in front of a sanitary or social danger the particular gravity of which it would have been estimated. On the contrary, we examined the practices of the power which transform certain substances into illicit drugs and their users in drug addicts. So, the use of the addiction fact in the high spheres of the govemments, not allowing any more to break with the common opinion according to which the drug user is promised to the crime and must be taken care by specialized institutions, the war in the drug, even in a democracy strengthened as Canada, cracks even today the social, political and legal order, and the repression is always legitimized, at the very moment when certain grey zones there, where guaranteed which protect the physical integrity and the independence of the individuals are far from being always respected, make doubt the consolidation of the democracy. As for the repressive action against the users of spsychotropic substances we shall see that it results of a set of practical constraints and of legal and polioe confusions which allow, neither to eliminate the drug trafficking, nor to fill the objectives indispensable to the conservation of the public health. More disturbing, the penalization of the manners brought an intensification of the criminalization of minor offenses, the increase of the postponed breaches and the stigmatization of social groups, without making decrease the frequency of the practices of consumption, nor eliminate the jamming of the objectives of care of the problematic users. The incoherence of a system, which cannot escape any more the coexistence of its policy of prohibition and the pragmatic approach of the reduction of the misdeeds which, at the end of line, looks more after the perverse effects of the penalization than those of the abuse or the drug addiction, can only call up to a reform of the system. Reform of the system; that the international Agreements and their openings let the signatory states free to choose. If such was their will , to suppose that these last ones decide not to make any more of drug a political bargaining chip, they could opt for a real public policy in drug addiction susceptible to replace the eradication by the prohibition by a model which would reconcile the simple usage of drugs and promotion of the health, each could then speak on his/her behalf and the action of some would not damage any more the mission of the others.
