Bill 39, (1997, chapter 75) The Act Respecting The Protection Of Persons Whose Mental State Presents A Danger To Themselves Or To Others "Art.8. A Peace Officer may , without the authorization of the court take a person against his will to an institution described in section 6 1. at the request of a member of a crisis intervention unit who considers that the mental state of the person presents a grave and immediate danger to himself or to others." The new mental health law of Québec of 1997, "The Act Respecting The Protection Of Persons Whose Mental State Presents A Danger To Themselves Or To Others ", has required that a Crisis Intervention Service be made available across Québec to collaborate with the Police to implement a specific article, article 8 . Crisis Intervention Units are asked to supply trained crisis intervention workers to assist police with their decision whether or not to take a person against his will to an institution to be examined by a physician and possibly placed under preventive confinement. Thus, Crisis Intervention Units must be appointed in all 18 Régie régionale de la santé et des services sociaux (RRSSS) funded by MSSS in the province of Québec to comply with this New Law. Who will provide this service and how will it be delivered? The central subject of this thesis concerns the legal and practical implications of these Crisis Intervention Units designed to take action in crisis situations and their members known as Crisis Intervenants. What are these Intervenants actually being asked to do in the New Law, how will they go about doing it, and in what way could they be held responsible for the execution or non-execution of such actions? These are the questions that this paper will endeavour to answer. The answers will permit us to conclude what The Civil Responsibility Of An Intervenant of A Community Crisis Intervention Center Of Quebec are the civil responsibilities of the Crisis Intervenants of a mandated Crisis Intervention Service in the application of article 8 of the New Mental Health Law.
