Résumé
The present essay deals with certain aspects of the reality of mentally disordered accused in Quebec society in relations with the Canadian penal justice system. A long awaited reform put an end to the centennial reign of the dispositions, following the ultimatum issued by the Supreme Court through Swain. Almost eighty new sections regarding the mentally disordered accused, were integrated into the Criminal Code creating important procedural safeguards . All these modifications are presently in application with the exception of three concerning the issue of capping and the mentally disordered dangerous offender. Canadian Courts as well as practitioners have had to look into these new dispositions and see to their daily application. Many principles are now clearly established while ethers are still awaiting a definitive answer. Furthermore, although the criteria for the determination of fitness to stand trial has remained untouched by this reform, the recent jurisprudential tendencies on this subject emerging following the Taylor and Whittle judgements constitute a definite set back . The question of fitness to stand trial is the cornerstone of the integrity of our legal system. On the other hand the accused, declared unfit to stand trial or not responsible on account of mental disorder, no longer being detained «until the pleasure of the lieutenant governor is known», the dispositions regarding the release at section 672 .54 C.cr. have warranted the creation of provincial Review Boards to insure follow up. Furthermore, this disposition exists within a provincial judicial and social context wich we need to compose with. The treatment against the will of the accused being proscribed for the purpose of the application of the Criminal Code, with the exception of a maximum period of 60 days and for the sole purpose of rendering him fit to stand trial, we have to refer to the multiple provincial legislations, all having their respective mission. This study will attempt to bridge the modalities of detention and treatment of the accused under the Criminal Code and the dispositions relative to the treatment of the mentally ill person in a Civil Law context.
