In a context of the widespread proliferation of abuses against temporary migrant workers, extensively documented, this thesis seeks to explore the justification of the temporary migrant worker status. Inspired by numerous already available empirical research giving a voice to these workers, historical research, and theoretical analyses in law, political economy, and philosophy, this thesis aims to be a systemic theoretical reflection on what constitutes the regulation of temporary migrant workers, its justification, and its concrete implications on the fundamental rights of the workers concerned.Through the exploration of different approaches to unfree labor, the first part addresses the way in which, depending on its conceptualization, this notion can both serve to justify the temporary migratory status for work as it exists today, or denounce it as a system of racialized exploitation. A theoretical approach to unfree labor inspired by neo-Marxist readings highlights the systemic nature of unfree labor relations and the role of the state in their proliferation by demonstrating on one hand that the market is a political and legal construct and on the other hand that law is part of a racialized post-colonial history whose exclusions are still reproduced today through the maintenance of hierarchical racialized statuses.These theoretical and conceptual foundations then serve as the basis for the analysis of the normative framework of the temporary status for work in Canadian law in the second part. First, through a historical overview of the construction of the temporary migrant worker from the British Empire to today (as a legal and ideological backdrop upon which the figure of the migrant has been constructed in the modern collective imagination), and then by studying the current Canadian normative framework governing the temporary migratory status for work, this analysis highlights the continuity of historical processes of dehumanization and racial subordination that are still operating in the current regulation of migrant work but normalized and concealed through a multitude of seemingly neutral categories. Finally, this temporary migratory status for work in Canadian law as a post-colonial exploitation system of racialized workers is discussed in light of the right to equality protected by the Canadian Charter of Rights and Freedoms as representing a systemic discrimination at the intersection of race and professional status for racialized temporary migrant workers considered as low-skilled
