Résumé L’auteur présente une fonction nouvelle et alternative de la sanction pénale : la contre-impunité qu’il distingue de l’anti-immunité. Il en illustre la définition – punir juste assez pour que les lois exercent leur pouvoir normatif, mais pas plus – à travers l’exemple du Rwanda, caractérisé par l’éclatement de son cadre institutionnel et les dérives qui en résultent. Quant à la criminalité de droit commun, la contre-impunité part du principe que la punition des transgressions manifestes actualise la vitalité sociale de la norme. Le fondement de la sanction se déplace, dans cette perspective, de la punition de l’individu au maintien de la vie en société.
