La France et le Canada présente la particularité d’avoir au sein de leur communauté nationale des populations autochtones. Par contre, si les autochtones canadiens sont présents sur le seul territoire d’Amérique du Nord du Canada, ceux de France sont situés dans les territoires ultramarins de la République (Nouvelle-Calédonie et Guyane française). Dans les deux cas, le droit national a des défis à relever qui concernent essentiellement la satisfaction de revendications culturelles et foncières. La présence d’autochtones au Canada et en France interpelle le chercheur sur plusieurs points : la notion de peuple, l’intégration de communautés particulières à la communauté nationale, l’élaboration d’un droit des autochtones au Canada et en France. À ce propos la démarche comparée est intéressante dans la mesure où la France est un État unitaire décentralisé alors que le Canada est un État fédéral. La question n’est pas traitée de manière identique, et les solutions proposées de part et d’autre sont dignes d’intérêt pour les deux pays.
