Abstract
Dans la tradition civiliste, le notaire est un officier public et un professionnel du droit qui reçoit de l’État une parcelle de son autorité pour l’authentification de faits et d’actes juridiques. Or, l’institution notariale présente au Québec depuis 1621 assume à l’intérieur du système civiliste des traits caractéristiques distinctifs en raison du contexte particulier dans lequel elle a évolué. La conquête de la Nouvelle-France par les Anglais en 1760 laissa le notariat québécois orphelin au milieu d’un continent dominé par les principes de la common law. Ainsi détaché de ses racines françaises et influencé par l’entourage nord-américain, le notariat québécois revêt une physionomie particulière qui marque la rupture et la continuité de la tradition civiliste en territoire canadien.DOI:http://dx.doi.org/10.15304/dereito.24.1.2372
