Abstract
The central thesis of this study is that a faculty of theology which operates within a secular university largely subsidized by the state cannot be considered an ecclesial institution and thus subject to a foreign authority. At the same time, it is possible to offer programs of formation which correspond to the requirements of ecclesial legislation. To demonstrate this thesis, the A. presents a case study of the faculty of theology and religious sciences at Laval University. After an analysis of the evolution of church-state relations in the areas of education, health and social services in Quebec, the A. underscores the challenges posed to the faculty in the 21st century. He specifies the roles and responsibilities concerning the formation of pastoral ministers in this context of pluralism and of the transfer of institutional responsibilities from the Church to the state. The A. seeks to demonstrate that the authority which governs the relations between the state, the Church and the civil society is the charter of rights and freedom of the person which dominates every expression of organic rapport between the Church and the state. The A. also gives different interpretations which the Canadian tribunals have given to religious freedom.
