Abstract
An analysis of the prerequisite of originality for copyright protection to attach. The paper analyzes the differing approaches in Ireland, the United Kingdom, Australia, Canada and the United States along with some other illustrative jurisdictions. The general tone of the paper is that there seems to be no consensus on the appropriate standard to adopt. The judicial confusion which is rampant in the decisions is far from acceptable. If the existence of a copyright in the first place is premised on a Lockean-rights foundation. Do the decisions accurately or adequately uphold this fundamental right?
