Abstract
Sous la Troisième République, la procédure de correction paternelle, qui permettait au père outragé d'exiger ou de demander l'incarcération du mineur insoumis, est de plus en plus rarement appliquée. L'étude des évolutions de la législation et des pratiques judiciaires montre que l'on ne reconnaît pas au père un droit absolu de correction. La suspicion, la place accordée aux devoirs à l'égard de l'enfant, mais aussi les demandes des familles font évoluer les solutions. Le père est de moins en moins regardé comme une victime, une autorité à laquelle la société rend justice en prenant en charge la correction du mineur. Alors que l'image de l'enfance insoumise se dissout dans celle de l'enfance en danger moral ou inadaptée, le père d'origine populaire devient un suspect ou un assisté.
