LA BUSQUEDA DE EQUILIBRIO ENTRE IGUALDAD Y TUTELA DE LAS DIFERENCIAS CULTURALES. LOS INSTRUMENTOS CONSTITUCIONALES PREVISTOS POR LA CARTA DE LOS DERECHOS Y LIBERTADES: 1. La clausula no obstant, el principio multicultural y el de la accomodation.- IV. CONTINUACION: 2. La teoria de los inherents rights y el principio de autogobierno. RESUMEN El principio multicultural representa una elemento clave en la comprension de los cambios institucionales que se estan llevando a cabo; y la experiencia canadiense, si bien no debe ser considerada como un modelo, se erige en un importante punto de vista. Este articulo se centra en como la Carta Canadiense representa el punto de partida en la revision del proceso de transicion de un Estado multinacional a multicultural, y analiza las diversas clausulas de la Carta que tienen como fin intentar equilibrar la proteccion de los derechos humanos universalmente reconocidos con los derechos de identidad.
