Abstract
Na pesquisa bibliográfica realizada e no raciocínio desenvolvido ao longo do texto, intenta-se analisar os direitos humanos e a sua correlação com o Estado na pós-modernidade. Nesse iter, torna-se imprescindível o diagnóstico acerca das transformações e crises do modelo jurídico que ainda segue fortemente marcado pelo Estado. Todavia, diante de inúmeros abalos sofridos por esta Organização Estrutural – que ainda se mantém como a mais importante instituição da modernidade – causados principalmente pelo fenômeno da globalização (em seus diferentes perfis), o direito contemporâneo se mostra insuficiente diante de tanta complexidade. Isso ocorre porque o paradigma jurídico ainda segue atrelado a uma racionalidade insatisfatória, na medida em que nega a diferença e abomina os paradoxos. Portanto, a fim de oferecer contributos para a construção de um Direito mais coerente com o veloz século XXI, com aporte na teoria pragmático-sistêmica, intenta-se, no artigo subseqüente, apresentar uma observação dos direitos humanos (fundamentais) com base nesse novo paradigma como matriz teórica do Direito. Nesse sentido, como canal privilegiado de discussão dos paradoxos da pós-modernidade, aborda-se a função dos direitos fundamentais, a sua relação com o Estado, bem como a importância da democracia como mecanismo para a manutenção da abertura das possibilidades de sentido dos direitos humanos.
