Abstract
Siendo tradicionales e inevitables las zonas de contacto e, incluso, solapamiento entre el Derecho Penal y el Administrativo, que propician la utilización por el legislador de uno y otro como “reserva de implementación” respectiva para asegurar el adecuado control social, y habiéndose progresado en este terreno, lo cierto es que, hasta hace poco, el recurso al Derecho administrativo había venido siendo preferente, dando lugar a un notable proceso de administrativización de medidas penales, pero en la actualidad esa preferencia parece poder estar siendo sustituida por una de signo inverso.
