Abstract
Au Québec, la Loi sur les normes du travail reconnaît le droit de la personne salariée à un milieu de travail exempt de harcèlement psychologique. Le recours de la personne syndiquée est le dépôt d’un grief. La lecture des décisions arbitrales révèle un langage parfois plus psychologique que juridique, surtout associé au rejet des griefs. Ce langage traduit un regard sévère sur les personnes qui portent plainte, faisant porter l’enquête sur le caractère « normal » de leur personnalité et la présence d’une maladie mentale chez elles. La tendance à une lecture psychologisante des griefs pour harcèlement a pour effet d’écarter l’analyse sociale et organisationnelle des milieux de travail. L’intention du législateur était pourtant d’assainir les milieux de travail par un examen critique de l’organisation du travail et de l’exercice du droit de gérance.
