Au Québec, plusieurs dispositifs institutionnels amènent les juges à s’investir particulièrement dans les affaires mettant en cause la capacité des parents qui se séparent à s’occuper de leurs enfants. L’enquête ethnographique menée dans trois tribunaux montre comment juges et avocat-e-s donnent crédit aux accusations de déviance, mais aussi quels sont les ressorts structurels de ces accusations, situés au cœur des rapports sociaux de classe, de « race » et de sexe. Le contrôle judiciaire de la parentalité s’avère très inégal, différenciant fortement les rôles paternel et maternel et pesant plus durement sur les justiciables de classe populaire, en particulier ceux issus de l’immigration.
