Au Québec, trois lois garantissent le droit à l’égalité et le principe de non-discrimination dans l’emploi. Il s’agit de la Charte canadienne des droits et libertés, de la Charte des droits et libertés de la personne et de la Loi canadienne sur les droits de la personne. Chacune de ces lois assure une protection contre les atteintes discriminatoires fondées sur l’âge qui peuvent avoir cours tout au long du parcours de vie professionnelle d’un travailleur, quel que soit son âge ou le groupe d’âges auquel il appartient. En comparaison avec les autres motifs de discrimination punis par la loi, l’âge sème une certaine confusion et reçoit, du gouvernement québécois comme des différentes instances juridictionnelles, un traitement distinct. En effet, dès l’accès à l’emploi et jusqu’à la rupture du lien d’emploi, une personne peut faire l’objet d’une différence de traitement fondée sur l’âge. Lorsqu’une distinction fondée sur l’âge dans l’emploi est prouvée, un employeur, et parfois le gouvernement, doit alors apporter une explication raisonnable pour justifier sa décision ou, s’il reconnaît que l’âge l’a influencée, il peut fournir une justification à cette distinction. Trois justifications des différences de traitement fondées sur l’âge peuvent être invoquées: l’exigence professionnelle justifiée, la promotion sociale et l’utilisation non discriminatoire de l’âge dans le domaine des assurances, des rentes, des avantages sociaux et de la retraite.
