Abstract
Este trabajo se ocupa de la determinacion de la legislacion aplicable, segun el estado actual de la legislacion espanola, en los casos en los que nace una pretension de danos con elementos internacionalmente relevantes. El estudio se inicia con el analisis del regimen legal previsto en el art. 10.9 CC (Apartado 2) y pasa a continuacion al tratamiento de la cuestion en el regimen convencional (Apartado 3). En este punto nos detendremos en el analisis del Convenio de La Haya de 1973 sobre Ley aplicable a los danos causados por productos defectuosos y del Convenio de Montreal de 1999 sobre transporte aereo internacional, asi como de los reglamentos comunitarios sobre esta ultima materia. El trabajo finaliza con el analisis de las ultimas aportaciones a la discusion sobre la Propuesta de Reglamento del Parlamento europeo y del Consejo relativo a la ley aplicable a las obligaciones extracontractuales, conocido como Roma II (Apartado 4).
