Competing Class Actions Across Canada: Still at the Starting Gate after Canada Post v. Lépine

Abstract
Questions relating to jurisdiction and recognition of multi-jurisdictional class actions remain unanswered by the Supreme Court of Canada despite an opportunity to do so in Canada Post v. Lepine. In this comment I present the particularities of the Quebec regime for recognition of foreign class actions, including its unique lis pendens rule, in light of the Supreme Court's ruling in Lepine. While the court left the constitutional problems unresolved, the decision invites renewed inquiry into the distinct nature of consumer class actions and novel approaches to the jurisdictional challenges they pose in the transborder context.
