Le XIXe siècle est marqué par l’avènement d’institutions de placement particulières aux mineurs délinquants et en danger et par une amorce de traitement judiciaire spécifique des causes qui les concernent. C’est au début du XXe siècle que, presque simultanément, plusieurs pays adoptent des lois créatrices des tribunaux pour mineurs. Cette simultanéité est-elle le fruit de simples coïncidences chronologiques ou reflète-t-elle l’existence de convergences ? L’examen de l’adoption des lois concernées en Belgique, en France, aux Pays-Bas et au Canada montre qu’un modèle de protection de l’enfance est l’objet de débats dans les quatre pays; il n’est toutefois véritablement adopté que dans trois d’entre eux, la France conservant quelque distance à son endroit. Ce modèle s’incarne dans des acteurs nouveaux : le juge des enfants, partiellement inspiré de celui pour lequel les Américains ont opté, et le délégué à la liberté surveillée. Les convergences entre les pays apparaissent encore plus clairement dans l’examen du processus de production des lois, qui est marqué par la contribution très importante d’acteurs extraparlementaires.
