Abstract
Dans cet article, nous proposons une analyse sociologique du moment juridique de mise en oeuvre de la régulation de la diversité religieuse qu’a constitué la décision du Conseil d’État du 27 juin 2008 refusant la nationalité française à une ressortissante marocaine qui portait la burqa. Nous entendons démontrer l’hypothèse selon laquelle cette décision s’inscrit dans un raidissement de la « laïcité narrative », un raidissement préalablement conforté par l’adoption du rapport de la Commission Stasi en 2003 puis par le vote de la loi du 15 mars 2004 relative au port de signes manifestant ostensiblement une appartenance religieuse dans les écoles, collèges et lycées publics. Nous montrons qu’harmonisant ainsi « laïcité narrative » et « laïcité juridique », cette décision du Conseil d’État a constitué un point d’ancrage solide au développement d’une rhétorique républicaine sur l’aménagement du religieux, alimentant en retour la « laïcité narrative ».
