Abstract
Les débats relatifs à la paternité, ces dernières décennies, en France, ont été essentiellement portés, dans le champ politique comme dans celui de la recherche, par la question de l'établissement de la filiation et du découplage de la filiation et de l'alliance (affaiblissement de la présomption de paternité dans le cadre du mariage, abolition de la plupart des distinctions entre enfants nés dans le mariage et enfants nés hors mariage) et par celle de la dévolution ou du partage de l'autorité parentale entre les parents divorcés ou non mariés. Ces débats ont mis en avant «l'intérêt de l'enfant » ou les « droits de l'enfant » à voir sa filiation établie, à ne pas souffrir de discriminations en raison des circonstances de sa naissance et à maintenir des relations avec ses deux parents : un « droit au père » plus que des « droits du père ».
