Abstract
La Communauté économique et monétaire de l’Afrique centrale (CÉMAC) a été créée en 1994, presque au même moment que l’Organisation mondiale du commerce (OMC), pour permettre l’intensification des échanges commerciaux entre ses États membres. Cette organisation régionale a pu élaborer un droit douanier communautaire qui assure le partage des compétences entre la Communauté et les États membres en matière douanière, et organise le processus de dédouanement des marchandises ainsi que le contentieux douanier. Ce droit douanier communautaire a le mérite de s’arrimer aux règles de l’OMC en matière d’évaluation en douanes. Cependant, sur un plan général, l’application des règles douanières de la CÉMAC n’est pas uniforme au niveau des différentes administrations douanières des États membres; ce manque d’uniformité dans l’application des règles douanières communautaires de l’Afrique centrale ne répond pas aux exigences du GATT de 1994.
