Abstract
Depuis les années 2000, la Cour suprême du Canada a réintroduit le concept de liberté contractuelle en matière conjugale. Les contrats de mariage et les ententes de divorce, dans la mesure où ils respectent la loi, sont validés par les tribunaux, même s’ils sont désavantageux pour les femmes, au nom du respect de la liberté contractuelle des parties. Le contrat représente la volonté des parties. La présente réflexion porte sur l’influence du droit à l’égalité entre les sexes, protégé par la Charte canadienne des droits et libertés et la Charte des droits et libertés de la personne du Québec, sur les contrats conclus dans le contexte d’une relation conjugale.
