On a assisté depuis l'entrée en vigueur du droit au retrait préventif à une croissance rapide et continue de la demande pour ce programme, qui touche aujourd'hui une travailleuse enceinte sur quatre. Les demandes acheminées vers la Commission de la santé et de la sécurité au travail ont par ailleurs beaucoup plus souvent conduit à des arrêts de travail précoces qu'à un processus de réaffectation comme les concepteurs de la mesure l'auraient souhaité. Après avoir passé en revue les enjeux soulevés par cet effet inattendu de la législation, les auteurs dressent un portrait statistique des utilisatrices et proposent quelques hypothèses d'explication sur l'étonnante popularité de la mesure, à partir des premiers résultats d'une recherche (combinant une approche quantitative et qualitative) conduite auprès de travailleuses qui se sont prévalues de ce droit en 1984 et 1985. Ils suggèrent qu'au moment de concevoir la mesure, le législateur a sous-estime la pénibilité des tâches dévolues aux femmes et par conséquent le nombre de travailleuses susceptibles d'invoquer un facteur de risque au poste de travail en plus de se heurter à la résistance des milieux de travail, peu disposés à mettre de l'avant des politiques de réaffectation.
