À la fin du XVIIIe siècle la mainmorte n’est pas en France un droit seigneurial devenu insignifiant, comme le remarque d’emblée l’auteur : elle concerne 500 000 à un million de sujets dans une vingtaine de pays, 57 coutumes territoriales dont 24 générales. Depuis la fin du XVe siècle il ne s’agit plus d’une attache du dépendant à la glèbe, mais on distingue encore la mainmorte « personnelle » ou « de corps », héréditaire et rompue par contrat d’affranchissement, qu’on trouve en Lorraine, Alsa...
