Abstract
The 1983 Code introduced an innovation in the history of canon law in translating intojuridic terms certain theological teachings of Vatican II, thus being closer to Revelation and Tradition than was the 1917 Code. One such aspect is the mention in the Code of God's presence and activity in the Church. The focus of this essay is on the Holy Spirit in the Code. The A. laments the fact that the Holy Spirit is mentioned only seven times in the Latin Code in contrast to seventeen times in the Eastern Code. There are evident places in the Latin Code where the Holy Spirit could have been mentioned but was not, such as in the foundational canons on the liturgy and the sacraments at the beginning of Book IV Nevertheless, the A. finds that the few canons referring to the Holy Spirit are in continuity with the teaching of Vatican II and, taken together, express the diversity of the Spirit's action.
