Abstract
Anti-terrorism laws could be constructed and defended without reference to the problematic idea of militant democracy, namely the idea that democracies are justified in denying freedoms associated with democracy to those who reject democracy. Terrorism as violence directed at civilians could be punished as ordinary crime. Murder is murder. It is not excused because the criminals acted with extremist political or religious objectives or motives. The ordinary criminal law also does not necessarily require democracies to wait until it is too late and the terrorists have caused death and destruction. If properly identified, terrorists could be apprehended and punished under the ordinary criminal law when they have formed conspiracies or attempted to commit crimes such as bombings and assassinations. Such a traditional crime-based approach should be far less problematic for Western democracies than prohibiting expression or associations that are found to be inconsistent with the tenets of democracy.
