Avant de prétendre à un code de déontologie, le traducteur est tenu de se conformer à un droit. De fait, on constate que les deux documents qui visent à améliorer la condition du traducteur et lui préciser ses droits et devoirs sont la Recommandation de Nairobi (1976) et la Charte du traducteur (1963-1994). Or, ces documents ne sont pas contraignants et n’ont pas de valeur juridique autonome dans la mesure où ils sont soumis à la législation qui administre le droit du traducteur qui est, en l’occurrence, le droit de l’auteur. Alors que sur le plan philosophico-juridique le droit du traducteur est sous-tendu par les déterminants d’un droit de la traduction et du métadiscours littéraire sur l’auctorialité, cet article tente de mettre au jour une éthique du traducteur, dans le contexte du déséquilibre dans la production du savoir et de la culture entre pays industrialisés et pays en développement, qui réponde aux besoins de la construction d’un nouvel ethos traductif, d’une nouvelle identité pour le traducteur. Dans le prolongement des pensées philosophiques derridiennes et de la traductologie post-coloniale, il s’agira d’énoncer les principes qui devraient contribuer à penser l’élaboration d’une éthique traductive « citoyenne et altermondialiste ».
