Les critiques de Foucault ne cessent de souligner l'absence de critères normatifs dans son œuvre et ils fondent ce reproche sur l'absence de toute conception du sujet. Contrairement à de telles interprétations, je soutiens que l'œuvre de Foucault présuppose un concept de la matière humaine sur laquelle le pouvoir s'exerce ou qui exerce un pouvoir sur elle-même. Cette matière humaine doit être comprise sous l'angle du pouvoir, dans le sens premier de ce terme, soit la capacité d'être ou de faire certaines choses. Bien que cette " mince " conception du sujet ne fournisse pas d'assise à un jugement normatif qui pourrait satisfaire Fraser ou Habermas, elle permet de distinguer la domination des autres formes du pouvoir. Bien plus, si nous posons quelques hypothèses minimales au sujet de la nature active et des capacités particulières de l'être humain, la conception que Foucault a du sujet fournit une base qui nous permet de comprendre non pas la désirabilité, mais l'inévitabilité de la résistance à la domination.
