Abstract
Résumé Cette contribution vise à distinguer les principaux modes alternatifs de régulation des conflits (Marc). Ainsi, l’auteur présente la médiation, la conciliation, la négociation, l’arbitrage et la transaction. Les définitions proposées se fondent sur les dimensions juridiques et déontologiques de ces divers modes alternatifs et sur leurs principaux référentiels. Afin de mieux les caractériser, leurs champs d’intervention respectifs sont ici précisés. Il s’agit enfin de considérer la médiation dans une perspective dynamique et comparative avec ces autres modes de régulation.
