Abstract
Jean-Paul Brodeur, criminologue canadien récemment disparu, s’interroge sur l’éthique des « agents policiers ». Partant du constat que la police, qui jouit du droit à « l’illégalisme légalisé », peut être conduite à transgresser certaines lois pour mener à bien ses missions, l’auteur propose une typologie de situations où la déontologie des agents peut se trouver malgré tout mise en cause. Les propos de l’auteur traduisent l’idée que la responsabilité éthique d’un agent ne se trouve pas engagée par l’usage de moyens d’exception légalisés, mais dès lors que cet usage excède un « principe de parcimonie » (usage de la force minimale) constitutif de sa fonction « d’agent policier ».
