Abstract
Résumé Le patrimoine familial est une disposition insérée dans le droit de la famille québécois en 1989, qui impose le partage d’un certain nombre de biens entre les conjoints en cas de divorce ou de décès, quel que soit le régime matrimonial. Cette réforme va à l’encontre du mouvement général de désinstitutionalisation du droit de la famille. À partir d’une analyse du processus politique, nous montrons qu’elle a été rendue possible par la conjonction de deux formes de mobilisations féministes, dans la société civile et dans les institutions. Ainsi, l’analyse de cette réforme, à partir d’une sociologie politique du droit, est riche d’enseignements du point de vue de la sociologie de l’État, contribuant à une remise en question de la dichotomie État-société.
