Abstract
Questo studio presenta la descrizione della "dimensione ambientale della salute". Tale dimensione si colloca su un piano concettuale che si pone tra sfera sociale e giuridica. La "dimensione ambientale della salute" delineata nella sfera giuridica si compone di tre matrici che descrivono un quadro teorico innovativo nel quale il diritto alla salute si confronta con il campo ambientale e della sostenibilitŕ. La prima matrice concerne in modo particolare il diritto all'ambiente salubre, che talvolta č stato interpretato come mero prolungamento del diritto alla riservatezza della vita privata e familiare, altre volte come diritto che si coniuga all'integritŕ culturale e all'identitŕ di un popolo; la seconda matrice riguarda un diritto alla salute che si relaziona con aspetti ambientali ma che non rientra esattamente nel diritto all'ambiente salubre e che contempla tanto casi di quanto una nuova prospettiva sociologico- giuridica nello studio del diritto alla salute, che inerisce alla rivendicazione di tale diritto in quanto leso dai cambiamenti climatici (esemplificativi i casi riguardanti la petizione degli Inuit e Kivalina); la terza matrice invece č volta a costruire un "diritto sostenibile alla salute", che comprende tanto il diritto alla salute quanto quello in materia di sviluppo sostenibile.
