Abstract

L’article s’appuie essentiellement sur le changement de statut juridique d’une sanction pénale pour explorer les conditions d’émergence d’innovations au sein des systèmes pénaux occidentaux contemporains. En 2002, les travaux communautaires belges sont en effet passés du statut de mesure à celui de peine. Or, les systèmes pénaux modernes donnent généralement peu de crédit aux travaux communautaires et sont hostiles à toute évolution qualitative. Pourtant, des traces d’innovation se retrouvent dans la création, l’application et l’encadrement des travaux communautaires. Quatre scénarios seront ainsi évoqués au niveau de leur seul encadrement: les scénarios conventionnel, formel, pédagogique et enfin innovant.
