A dificuldade de dimensionar limites entre o conhecimento tradicional e o conhecimento científico dá margem a indagações sobre a apropriação de bens considerados (mesmo que em sentido simbólico) patrimônio da humanidade, como o genoma humano e das plantas, para transformá-los em produtos. Nesse contexto, o presente trabalho de investigação busca analisar a proteção legal dos conhecimentos tradicionais relacionados à biodiversidade e verificar se é possível vislumbrar uma posição de equilíbrio com o fim de reverter, de forma compartilhada, os benefícios da industrialização e da comercialização dos produtos que se baseiam nos conhecimentos tradicionais.
