Au départ d’une expérience de deux années comme juge à la nouvelle Cour européenne des droits de l’Homme, l’auteur aborde successivement quatre questions. Tout d’abord, les raisons de la restructuration du mécanisme de contrôle de la Convention européenne des droits de l’homme entré en vigueur le 1er novembre 1998 et qui constituent autant d’attentes par rapport à la nouvelle Cour. Ensuite, la physionomie de la nouvelle Cour laquelle, composée de quarante et un juges, est la plus grande juridiction internationale qui existe actuellement, ce qui est une invitation à de plus amples analyses en termes de sociologie juridique. Par ailleurs, les étapes essentielles de la procédure qui permet, devant la Cour, l’exercice du droit de recours individuel qui est au coeur du système de la Convention et qui lui confère son caractère original et unique dans l’ensemble des textes internationaux et régionaux de protection des droits de l’homme. Enfin, les défis majeurs auxquels la nouvelle Cour est confrontée et qui doivent être lus à la lumière de l’exigence de l’effectivité des droits fondamentaux.
