Abstract
A partir de 1º de janeiro de 2011, a Lei sobre a mediação da República Popular da China entrou em vigor e seu foco geral foi profissionalizar o sistema jurídico e orientar os jurisdicionados a procurar os tribunais estatais para resolver seus conflitos. A mudança da mediação visa também ao sistema judiciário, e os juízes estão, até o presente, obrigados a recorrer prioritariamente a ela. O estudo do caso chinês demonstrou que a primeira preocupação do atual regime reside em manter a estabilidade social, objetivo a que está submetido todo o sistema judiciário daquele país. O inimigo da estabilidade social é o conflito. Como também ocorre no Ocidente, na China é feita a associação entre a mediação e a harmonia. A preocupação obsessiva do regime comunista com a harmonia distorce o processo da mediação, que corre o risco de não ter mais voluntários, apesar das disposições legais incentivarem o contrário. Assim, o estudo demonstrou que vários fatores fragilizam a recepção da nova lei no contexto atual, tais como a questão do seu financiamento e da implementação efetiva dos comitês de mediação. Desta forma, esse novo regime de mediação é suscetível de conduzir a uma “ordenação imposta” e não negociada.
