Résumé Dans cet article, nous tentons de tracer les contours d’un problème sémantique qui nous paraît limiter l’évolution du système de droit criminel moderne et contribuer à la marginalisation des sanctions « positives ». Sont mises en cause les incidences et ramifications de certaines idées négatives bien appuyées par les auto-descriptions identitaires qui circonscrivent la fonction du droit criminel autour de la notion de protection de la société. Il y est hypothétiquement suggéré que cette sémantique, souvent sur le ton de l’urgence et de la nécessité, tend à reconduire, au sein même du système, des valeurs d’hostilité nuisant, voire empêchant l’avènement d’un système juridique capable d’apprentissage et d’autocorrection.
