The compensation of victims of avoidable incidents incurred in the context of health services delivery is an important concern. In Quebec, the liability plan is one of fault liability. In order to be compensated, the victim must prove to a judge that she suffered from a professional error, that damages ensued and that there was a causal link between the error and the damages. It is a long and costly process. There are many cases where: (1) professional error is not easy to prove, (2) a causal link is difficult to establish, or (3) no professional error was committed. In these three specific cases, victims will not be compensated. Various reforms can be considered to improve the compensation of all victims of avoidable incidents (with or without fault and including therapeutic unknowns) : implementing a liability plan that does not take fault into account (a no-fault), creating a public compensation fund, creating "patient insurance"" but also implementing other measures complementary to deep system reforms (help with lawsuits, complaint mediation, risk prevention, etc.). The creation of a public compensation plan for victims of avoidable incidents regardless of fault is the most often suggested type of reform. We will therefore study the relevance and feasibility of such a plan. We will consider various compensation models (principle, characteristics, application modalities, etc.) and perform an economic analysis of potential reforms. The examination of compensation systems that already exist in other countries will allow us to refine our analysis regarding the feasibility of such reforms in Quebec. L'indemnisation des personnes victimes d'accidents évitables survenus lors de la prestation de soins de santé constitue une préoccupation importante. Au Québec, le régime de responsabilité est un régime de responsabilité pour faute. Pour pouvoir être indemnisée, la victime doit démontrer à un juge qu'elle a été victime d'une faute, qu'elle a subi des dommages et qu'il y a un lien de causalité entre la faute et les dommages. Les procédures sont longues et coûteuses. Il y a beaucoup de cas où : (1) la faute n'est pas facile à prouver, (2) le lien de causalité est difficile à établir ou (3) aucune faute n'a été commise. Dans ces trois cas précis, la victime ne sera pas indemnisée. Différentes réformes peuvent être envisagées pour améliorer l'indemnisation des victimes d'accidents évitables dans leur ensemble (avec faute ou non et comprenant les aléas thérapeutiques) : l'adoption d'un régime de responsabilité sans égard à la faute (le no-fault), la création d'un fond public d'indemnisation, le décloisonnement des régimes d'assurance en responsabilité, la création d'une « assurance-patient » mais aussi la mise en place d'autres mesures qui peuvent se révéler complémentaires aux réformes de fond du système (aides à la poursuite, médiation des plaintes, prévention des risques, ?). La création d'un régime public d'indemnisation des victimes d'accidents évitables sans égard à la faute est la réforme la plus souvent proposée. Nous allons nous interroger sur la pertinence et la faisabilité d'un tel régime. Nous allons étudier différents modèles d'indemnisation (principe, caractéristiques, modalités d'application, ?) et faire une analyse économique des réformes envisageables. L'examen des systèmes d'indemnisation existant dans d'autres pays nous permettra d'affiner notre analyse quand à la faisabilité de telles réformes pour le Québec.
