L’état en retrait ? Trente ans d’usages des peines

Abstract
Face à la crise de l’État social, de nombreuses analyses ont mis en avant la place prise par la pénalité dans les modes de régulation et de contrôle social, sur fond de montée en puissance du thème de l’insécurité à l’agenda politique. Cet article examine la question pour quatre pays sous l’angle, d’une part, des discours politiques et de changements législatifs, d’autre part, du recours aux peines d’emprisonnement et aux sanctions dans la communauté. Il conclut à la prégnance, dans chacun des quatre pays concernés, d’un processus d’extension du filet pénal marqué, d’un côté, par une intensité accrue de la répression des crimes graves, de l’autre par un développement significatif du milieu ouvert. Peines supplémentaires ou alternatives à la détention selon les périodes et les pays, l’ambivalence politique et pratique du milieu ouvert conduit à affiner et actualiser la notion de dualisation pénale.
